TEX—TERMS & CONDITIONS OF SALE

1.These are the terms on which TEX Solutions Pty. Ltd. (TEX) agree to accept the course registration specified. They represent the entire agreement between you and or your organization and TEX and by signing the course application form, submitting an online registration or submitting an official purchase order or confirmation email you accept these terms and agree that any terms and conditions that you may supply or have supplied to TEX will not apply.

2.Telephone or provisional registrations will be noted, but will not be deemed to be binding on TEX and TEX may resell the place provisionally reserved, unless and until TEX have confirmed receipt of written confirmation. Written confirmation can only be accepted by TEX in the form of an official purchase order or payment of the course fee and receipt of a completed course registration form, either online or faxed copy, duly signed and returned within five (5) working days of the provisional registration. TEX may, at its discretion, shorten or extend this period.

3.TEX will, on receipt of an online registration, official purchase order or a completed and signed course registration form with the course fee, issue an invoice, which must be paid in full 28 days prior to course commencement, unless the course commencement date is less than 28 days, in which case the course fees will be payable immediately the course registration is made.
4. Refunds, Course Reschedules and Cancellations - Should you wish to cancel the registration please notify TEX in writing. For cancellations received by TEX between fourteen (14) and twenty eight (28) days before the course commencement date, 50% of the course will be refunded. No refund can be given and the full course fee remains payable in respect of cancellations received by TEX within fourteen (14) days of the course commencement or in the event of non—attendance. For course date rescheduling requests received twenty eight (28) days or more before the course commencement date, 50% of the course fee will be charged. For requests to reschedule received less than fourteen (14) days before the commencement date there will be no refund of the course fee. Should you wish to send a substitute participant you may do so, providing the substitute participant meets all minimum prerequisites required for the specific course. If a substitute participant will be attending, please provide us with as much notice as possible.

5.TEX’s advertised prices are subject to change at any time. Details of up to date prices are available from TEX. TEX may increase the price of an accepted registration by giving you notice in writing of the increase. The notice will specify that you may, within thirty (30) days of receipt of the notice, give us a further notice cancelling the registartion. All payments made will then be refunded in full and neither party will have any further liability to the other in respect of the registration. If counter notice is not given the increased fee will become due in full.

6.TEX reserves the right to vary the location and / or the designated instructor of any course, but will  ensure that alternatives are suitable for the purpose.

7.In the event that TEX has to cancel a course for insufficient attendance or circumstance beyond their reasonable control notice will be given and TEX will, in full settlement of its liability to you, refund all payments made in full.

8.All course material, documentation, course handouts and similar items are subject to copyright owned by TEX and may not be reproduced in full or in part without prior written consent of TEX. Should customers require further copies of such documentation for colleagues of participants they should contact TEX who may be prepared to sell such copies to them, for a further fee.

9.The names and details of participants on all courses are confidential and you agree not to release such details concerning other attendees to any third party.

10.Reasonable care has been taken to ensure that all written material available at the courses and the content of the presentations, is correct as at the date stated in the written material. They take no account of updates in law or practice beyond that date. Written material should not be relied upon except by those who have attended a TEX course and should be read in conjunction with the instruction given at that course.

11.You are responsible for yourself and your participants whilst at TEX, the course location or in accommodation provided/recommended by TEX. You will indemnify TEX in full against any loss or damage cost or claim incurred by TEX as a result of your or their behavior, acts or omissions. Any participant who behaves in a manner deemed by TEX to be disruptive to the course or to other participants may be excluded from the course and no refund of fees will be made.

12.TEX accepts no liability for personal effects, motor vehicles or other items brought on to any such  premises by you or your participants and you will indemnify TEX against any claim which may be made against TEX for their loss or damage. This does not apply to death or personal injury caused by the  negligence of TEX.

TEX—PAYMENT TERMS

As stated above, confirmation of a provisional registration comprises of an official purchase order or an original signed course registration form with the course fees. Confirmation should then be received by TEX within five (5) working days of the provisional registration. The course fee is payable in full no later then twenty eight (28) days before the course commencement date.

Payment can be made by any of the following methods: Credit Card / Cheque / Electronic Funds Transfer (EFT) and Cash.

Cheques should be made payable to “TEX Solutions” and have the participant name, course title and course date clearly written on the reverse.

Credit cards accepted by TEX are Mastercard and Visa.

Bank details for Electronic Funds Transfer (EFT) payments can be obtained from the TEX accounts department.

If you or your company have not already confirmed this regsitration in the form of a purchase order, please enter a purchase order number OR enclose the course fee as appropriate.
